# ESPAÑOL # EXENCIÓN DE RESPONSABILIDAD, CESIÓN DE DERECHOS DE IMAGEN Y CONDICIONES DE PARTICIPACIÓN **Evento:** KGM HYBRID RACE / STRONGFIT RACE / KGM WORLD LEAGUE, según corresponda. **Organiza:** KGM CF GROUP S.L. Al inscribirse en cualquiera de estos eventos, el participante declara haber leído, comprendido y aceptar íntegramente las siguientes condiciones. ## 1. EXENCIÓN DE RESPONSABILIDAD El participante declara: - Que participa de forma voluntaria y bajo su propia responsabilidad, siendo consciente de la naturaleza física y exigente de la actividad deportiva. - Que comprende que la participación puede implicar riesgos inherentes a la práctica deportiva, incluyendo, entre otros, caídas, golpes, lesiones musculares o articulares, deshidratación, sobreesfuerzo u otros incidentes derivados del ejercicio físico, del material utilizado o de las condiciones del entorno. - Que exime de responsabilidad a **KGM CF GROUP S.L.**, así como a sus promotores, patrocinadores, colaboradores, personal, jueces, voluntarios, instalaciones colaboradoras y demás personas o entidades vinculadas al evento, por los daños, lesiones o perjuicios que pudieran producirse durante su participación, salvo en aquellos supuestos en los que la responsabilidad no pueda ser excluida conforme a la legislación aplicable. - Que se encuentra en condiciones físicas y médicas adecuadas para participar y que no padece ninguna lesión, enfermedad, condición médica o limitación que pueda agravarse como consecuencia de la actividad. - Que es responsabilidad del participante valorar su estado de salud y, cuando resulte necesario, obtener previamente asesoramiento o autorización médica para participar. - Que se compromete a respetar las normas de la competición, los standards establecidos para cada workout y las indicaciones de la organización, jueces, responsables de los Host Boxes o servicios médicos. - Que se compromete a actuar de manera responsable, prudente y deportiva durante toda su participación. - Que, en caso de necesitar asistencia médica, autoriza a la organización o al personal responsable a proporcionarle primeros auxilios o gestionar, cuando resulte necesario, su traslado a un centro sanitario. - Que asumirá los posibles costes derivados de dicha asistencia o traslado cuando estos no estuvieran cubiertos por el seguro correspondiente. ## 2. CESIÓN DE DERECHOS DE IMAGEN El participante autoriza expresamente a **KGM CF GROUP S.L.** a captar su imagen, nombre y voz mediante fotografías, vídeos, grabaciones u otros medios audiovisuales relacionados con su participación. Esta autorización podrá incluir contenido generado: - Durante la competición. - Antes o después de la realización de los WODs. - Durante entregas de premios. - En actividades relacionadas con el evento. - En KGM WL Host Boxes. - En vídeos enviados por los propios atletas o boxes como parte de la participación o validación de resultados. El participante autoriza, de forma gratuita y sin limitación territorial, el uso, reproducción, publicación, comunicación y difusión de dicho material en medios y soportes relacionados con la promoción, comunicación y difusión de KGM, sus competiciones y actividades. Estos medios podrán incluir, entre otros: - Redes sociales. - Páginas web. - Aplicaciones. - Material publicitario o promocional. - Fotografías. - Vídeos. - Prensa y medios de comunicación. - Retransmisiones. - Presentaciones. - Material relacionado con patrocinadores y colaboradores. La organización podrá utilizar dicho contenido directamente o conjuntamente con sus patrocinadores y colaboradores para fines promocionales, informativos y divulgativos relacionados con las competiciones, actividades y marca KGM. ## 3. PROTECCIÓN DE DATOS Los datos personales facilitados por el participante serán tratados por **KGM CF GROUP S.L.** conforme al **Reglamento (UE) 2016/679, Reglamento General de Protección de Datos (RGPD)**, y a la **Ley Orgánica 3/2018 de Protección de Datos Personales y garantía de los derechos digitales**. Los datos podrán utilizarse para: - Gestionar la inscripción y participación. - Gestionar clasificaciones y resultados. - Verificar scores. - Gestionar comunicaciones relacionadas con el evento. - Gestionar premios y reconocimientos. - Informar sobre futuras competiciones, eventos y actividades organizadas por KGM CF GROUP S.L., cuando proceda conforme a la normativa aplicable. El participante podrá ejercer los derechos que le reconozca la legislación aplicable, incluyendo los derechos de acceso, rectificación, supresión, oposición, limitación y portabilidad, dirigiéndose a: **kgmtrainingpeople@gmail.com** ## 4. ACEPTACIÓN DE LAS CONDICIONES La inscripción en el evento implica la lectura y aceptación de las presentes condiciones. La aceptación realizada durante el proceso de inscripción tendrá validez como manifestación expresa de conformidad del participante, sin necesidad de firma física adicional. Todo participante que no acepte estas condiciones deberá abstenerse de formalizar su inscripción. ## 5. CANCELACIONES, REEMBOLSOS Y TRANSFERENCIAS **KGM CF GROUP S.L. no realiza reembolsos de las inscripciones.** Si por cualquier motivo el participante no puede participar en el evento para el que se ha inscrito, podrá solicitar la transferencia de su inscripción: - A otra persona. - A otro evento organizado por **KGM CF GROUP S.L.**, cuando dicha transferencia sea aplicable y exista disponibilidad. Las transferencias son **GRATUITAS**. Cualquier cambio o transferencia deberá solicitarse con un mínimo de **15 días de antelación respecto a la fecha del evento o al inicio de la competición correspondiente**. Las diferencias económicas que pudieran existir entre diferentes eventos, categorías o modalidades podrán ser regularizadas cuando corresponda. --- # ENGLISH # WAIVER OF LIABILITY, IMAGE RIGHTS RELEASE AND PARTICIPATION TERMS **Event:** KGM HYBRID RACE / STRONGFIT RACE / KGM WORLD LEAGUE, as applicable. **Organizer:** KGM CF GROUP S.L. By registering for any of these events, the participant confirms that they have read, understood and fully accept the following terms and conditions. ## 1. WAIVER OF LIABILITY The participant declares: - That they are participating voluntarily and at their own risk and are fully aware of the physical and demanding nature of the sporting activity. - That they understand that participation involves risks inherent to physical activity, including but not limited to falls, impacts, muscular or joint injuries, dehydration, overexertion and other incidents arising from physical exercise, the equipment used or environmental conditions. - That they release **KGM CF GROUP S.L.**, as well as its promoters, sponsors, partners, staff, judges, volunteers, partner facilities and any other persons or entities connected with the event, from liability for any damage, injury or loss arising during participation, except where liability cannot legally be excluded under applicable law. - That they are in appropriate physical and medical condition to participate and do not suffer from any injury, illness, medical condition or limitation that could be aggravated by participation. - That it is the participant's responsibility to assess their health condition and, where appropriate, obtain medical advice or clearance before participating. - That they agree to comply with the competition rules, the standards established for each workout and any instructions given by the organization, judges, Host Box representatives or medical staff. - That they agree to act responsibly, safely and in a sportsmanlike manner throughout their participation. - That, should medical assistance be required, they authorize the organization or responsible staff to provide first aid or arrange transport to a medical facility when necessary. - That they accept responsibility for any costs resulting from such medical treatment or transport when those costs are not covered by the applicable insurance. ## 2. IMAGE RIGHTS RELEASE The participant expressly authorizes **KGM CF GROUP S.L.** to capture their image, name and voice through photographs, videos, recordings or other audiovisual media related to their participation. This authorization may include content recorded: - During the competition. - Before or after completing the WODs. - During award ceremonies. - During activities connected with the event. - At KGM WL Host Boxes. - Through videos submitted by athletes or boxes as part of participation or score validation. The participant grants, free of charge and without territorial limitation, permission to use, reproduce, publish, communicate and distribute such material through media and platforms connected with the promotion, communication and coverage of KGM, its competitions and activities. Such media may include, among others: - Social media. - Websites. - Applications. - Advertising and promotional material. - Photography. - Video. - Press and media publications. - Broadcasts. - Presentations. - Material involving sponsors and partners. The organization may use this content directly or together with its sponsors and partners for promotional, informational and communication purposes related to KGM competitions, activities and brand. ## 3. DATA PROTECTION Personal data provided by participants will be processed by **KGM CF GROUP S.L.** in accordance with **Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR)**, and **Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights**. Personal data may be processed for the purposes of: - Managing registration and participation. - Managing leaderboards and results. - Verifying scores. - Managing event-related communications. - Managing prizes and recognition. - Providing information about future competitions, events and activities organized by KGM CF GROUP S.L., where permitted under applicable data protection legislation. Participants may exercise any rights available to them under applicable legislation, including rights of access, rectification, erasure, objection, restriction and data portability, by contacting: **kgmtrainingpeople@gmail.com** ## 4. ACCEPTANCE OF TERMS Registration for the event implies that the participant has read and accepted these terms and conditions. Acceptance provided during the registration process will constitute the participant's express agreement to these terms, without the need for an additional physical signature. Any participant who does not accept these terms must refrain from completing their registration. ## 5. CANCELLATIONS, REFUNDS AND TRANSFERS **KGM CF GROUP S.L. does not provide refunds for registrations.** If, for any reason, a participant is unable to take part in the event for which they have registered, they may request to transfer their registration: - To another person. - To another event organized by **KGM CF GROUP S.L.**, where such transfer is applicable and subject to availability. All transfers are **FREE OF CHARGE**. Any change or transfer must be requested at least **15 days before the event date or the start date of the relevant competition**. Any price difference between different events, categories or competition formats may be adjusted where applicable.
